This privacy statement describes the information we collect about you and what may happen to that information. Although this statement may seem long, we have prepared a detailed statement because we believe you should know as much as possible about Insta-Bond 's practices so you can make an informed decision about becoming a client and using our services. Please review this privacy statement posted on the Insta-Bond website from time to time, as it may be amended without notice for some changes (for example, minor changes not affecting personal information. If, however, we are going to use users' personally identifiable information in a manner different from that stated at the time of collection we will notify users via email. Users will have a choice as to whether or not we use their information in this different manner. We will always post our most current privacy statement on the Insta-Bond website. Minor changes to our privacy statement will be effective upon such posting. By using the Insta-Bond website, you consent to the use of your information as expressed in this privacy statement. Notwithstanding the above provisions, Insta-Bond agrees to not resell, trade or rent any of your information to any third party. Client contacts receive service-related emails such as order confirmations, reminders, service announcements, scheduled system maintenance times, etc. You may not opt-out of these communications, which are not promotional in nature, without deactivating your account.


Visiting the Insta-Bond Website: The Insta-Bond website collects two kinds of information: (i) information that identifies you, your company, or your promotion(s) (collectively, "Identifiable Information"); and (ii) information that does not identify any person, company or promotion (such as your Internet Protocol (IP) address, browser type, operating system type, access time and page views) (collectively, "Non-Identifiable Information"). As a general policy, only Non-Identifiable Information is automatically collected from your visit to the Insta-Bond website.

Information Collected During the Client Application Process: In order to take advantage of the online registration and bonding services offered on the Insta-Bond website ("Services"), you or your company must be a client of Insta-Bond ("Client"). If you choose to apply to become a Client, you will be asked to provide us with certain specific information about yourself and/or your company, including: (i) contact information such as your name, phone number, fax number, mailing/e-mail address, and your company's name, phone number, fax number, mailing/e-mail address and primary contact person (collectively, "Contact Information"); and (ii) your federal identification number, sales promotion experience and other background information about you or your company (collectively, "Business Information"). We share part of your company's Contact Information and federal identification number with Dun & Bradstreet to obtain a Business Information Report on your company as part of our new client underwriting and evaluation process for potentially offering credit terms.

If we accept you as a Client and you decide to use our Services, we may share your Contact Information with our Surety Bond Carrier(s), the applicable government authorities responsible for regulating sales promotions in the jurisdictions for which you order registration and/or bonding services, the promotion sponsor or the industry attorney who has referred you (where authorized by you), VeriSign PayFlow Pro payment processing service and your bank and our bank if you elect to pay online for the Services by credit card, CT Corporation if you request us to provide representation services for you in the State of Arizona, as part of the Services, a certified translator that has executed a non-disclosure agreement with us if you request us to provide translation services of French to English in connection with the registration of your sales promotions in Quebec, and other third parties that perform functions on our behalf specifically in connection with the Services (such as companies or individuals that deliver packages). We may also share, where necessary, your Business Information with our Surety Bond Carrier and the applicable government registration authorities as required in connection with the Services. The Internet service provider that hosts our Web site will have a site administrator (our Webmaster) with the ability to access all such information as part of website maintenance, but this company and the Webmaster have signed a non-disclosure agreement with us. Your company, as part of becoming a client, will designate one or more client administrator(s). The client administrator(s) will have access to the Contact Information and Order Information entered on the Insta-Bond website by any client user authorized by the client to use the Insta-Bond website. Where applicable, if you are a promotion sponsor client that was referred to us by an industry attorney client, you may direct us to suspend disclosure of your Contact Information to the referring industry attorney by contacting us by e-mail. If you are a promotion agency client or industry attorney client, we will not contact or communicate with your client, the promotion sponsor, unless you request or authorize us to do so.

If you are an industry attorney, you may refer one of your clients to us. If you choose to do so, we may share your Contact Information with your referred client(s).

We will maintain your Contact and Business Information in our secure and protected information databases as long as you are an active Client. If you do not use the Services or refer a client to us for a period of thirty-six (36) months, or if your account is terminated for any other reason by you or us, we will deactivate this information.

Information Collected During the Order Process: As a Client, if you wish to order our Services, we will require that you provide us with your unique identifiers (e.g. Client I.D. number and password) and information specific to your promotion as required by the applicable government agencies and surety carrier(s), including the name and contact information of the promotion sponsor if different from your own, the promotion rules, promotion prize lists and winner's lists) (collectively, "Order Information"). If you elect to pay for the Services online by credit card or if you are not approved for credit invoicing during the Client application process, we will also require that you provide us with your credit card number and billing information (collectively, "Credit Card Information"). We may share your Order Information with our Surety Bond Carrier, the applicable government registration authorities and the promotion sponsor (if you request us to provide a copy to the promotion sponsor, as applicable).

We use a third party credit card processing company to bill users for Services paid for by credit card. This company does not retain, share, store or use personally identifiable information for any secondary purposes.

If you request us to provide representation services for you in the State of Arizona, as part of the Services, we will share the necessary information that you provide during order placement with CT Corporation, which will provide this service for us. We also will share communications sent to us in French by the Quebec Régie des alcools des courses et des jeux with a certified translator that has executed a non-disclosure agreement if you request us to provide French to English translation of these communications for you as part of our services related to registration of your promotions in Quebec.

We maintain all Order Information and all files related to the Services that we provide to you in our secure and protected information databases for a period of five (5) years after the date of order placement. If you or we terminate your account for any reason, we will deactivate this information after first offering to provide you with an electronic copy of all of your information that is scheduled to be deactivated.

We do not distribute your Contact, Business, Order, or Credit Card Information to parties other than those mentioned above, and we do not resell, trade or rent any of your information to anyone.

Non-Identifiable Information: We may aggregate Non-Identifiable Information to create statistical data, which will be used to help analyze site traffic and improve our services. We may also use such aggregated information to describe Insta-Bond 's website services to potential partners or other third parties. At no point, however, will the aggregated information identify you, your business, or your promotion(s).


We reserve the right to disclose any Identifiable or Non-Identifiable Information if required to do so by law or if we believe that such action is necessary in order to (i) conform with the requirements of the law or to comply with legal process served on Insta-Bond ; (ii) to protect or defend the legal rights or property of Insta-Bond , the Insta-Bond website, or its users; or (iii) in an emergency to protect the health and safety of Insta-Bond's website users or the general public.


For your convenience, we place "cookies" on your computer so that we may keep track of your activity on an individual and aggregate level and customize your experience on the Insta-Bond website. Cookies are small text files from a website that are stored on your hard drive which make using a website more convenient by saving your passwords and /or preferences for you. We utilize session cookies. A session cookie is a temporary cookie that is sent to your browser when you log onto the website and deactivated once you exit your browser or after some period of inactivity in your browser. Information from cookies may be analyzed and matched with the data provided by you to better secure all data and information within our servers. The session cookies will only store the Session I.D. for your visit and are linked to the personally identifiable information you submit while on our site. However, the session cookies are temporary, not shared with or transmitted to any third parties and are deactivated upon termination of the current session.


The Insta-Bond website may contain links to other sites, including websites of our Clients and service suppliers that are not maintained by Insta-Bond . We cannot guarantee the security of your Identifiable Information on those sites. Please review their privacy policy statement before submitting any Identifiable Information to such websites.


We have security measures in place to protect against the loss, misuse and alteration of the information under our control, both online and offline.

The Insta-Bond website operates secure data networks protected by industry standard firewall and password protection systems. We use an Entrust SSL Certificate for 128-bit encryption of data being sent via the Internet between the browser and our servers. All Credit Card Information is encrypted and securely transferred for credit card processing. The servers on which we store your personal information are kept in a secure environment using industry-standard back-up and security procedures and protections.

All new client applicant and client user information is restricted in our offices. Only employees who need the information to process your application or provide the Services are granted access to personally identifiable information. All employees have been verified as having a history of honesty and trustworthiness and have signed a non-disclosure agreement prohibiting the unauthorized disclosure, use or distribution of any client or user-related information. Furthermore, all employees are kept up-to-date on our security and privacy policies and practices and on the importance of maintaining and working with all client information in a secure and confidential manner.

Access to Insta-Bond 's offices is restricted after normal business hours with security cards required for entry into the building and keys required for office access. The building is also equipped with security cameras and a burglar alarm system and has a security guard on the premises after normal business hours and on weekends.

Although we strive to protect our users' personal information and privacy, please be advised that we cannot guarantee that the security precautions we take will prevent third parties from illegally obtaining your information.


If another entity acquires us or all or substantially all of our assets, your Contact, Business and Order Information, Non-Identifiable Information and any other information about our Clients that we have stored in our databases will be transferred to such entity as one of the transferred assets, but Insta-Bond agrees that any such transfer will continue to be subject to this or an equivalent privacy policy to be legally binding on the acquiring party and its assigns. If, as a result of this transfer, users' personally identifiable information is to be used in a manner different than that stated at the time of collection, users will have a choice consistent with our 'Notification of Changes' section below.

Notification of Changes

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the privacy policy under which the information was collected. If, however, we are going to use users' personally identifiable information in a manner different from that stated at the time of collection we will notify users via email. Users will have a choice as to whether or not we use their information in this different manner. However, if users have opted out of all communication with the site, or deleted/deactivated their account, then they will not be contacted, nor will their personal information be used in this new manner.


Each client user can access and update their personal information online. Each client also has one or more designated client administrators that can add or delete client users and access and update the information of the client and that of all client users.
